Terms and Condition

Welcome to Roobaroo. These Terms & Conditions (“Terms”) govern your access to and use of our website, social media pages, and any purchases you make from us (together, the “Services”). By using the Services, you agree to these Terms.

1)  About Us

Roobaroo (the “Company”, “we”, “us”, “our”) designs, markets, and sells apparel and accessories in Australia and internationally.

2)  Using Our Website
  • You must be 18+ or have a parent/guardian’s
  • Don’t misuse the site (no scraping, hacking, unlawful content, IP infringement, spam).
  • We may update, suspend, or restrict the Services at any time for maintenance or

  • We try to display colours, sizing and details accurately; minor variations can
  • Prices are shown in AUD and include GST unless stated
  • We may change prices or promotions at any time before you place an
  • Obvious pricing errors: we may cancel/refund orders placed at an incorrect price due to a genuine mistake.
4)  Orders, Acceptance & Availability
  • Your order is an offer to buy; we accept when we email a confirmation or ship your
  • If an item is unavailable after you order, we’ll cancel and refund that
  • We may cancel or refuse an order (e.g., suspected fraud, incorrect pricing, supply issues).
5)  Payment

We accept major cards and may offer third party payment options (e.g., Shop Pay, PayPal, Afterpay). Third-party providers have their own terms, please review them before using.

6)  Shipping, Risk & Title
  • Shipping options, costs and timeframes are shown at
  • Risk in goods passes to you on delivery; title passes once we receive full
  • If a parcel is returned to us due to incorrect address or non-collection, we’ll contact you to

rearrange delivery (additional shipping fees may apply).

7)  Australian Consumer Law — Your Non-Excludable Rights

Nothing in these Terms excludes, restricts or modifies your non-excludable statutory rights under the Australian Consumer Law (ACL). If a product has a fault or fails to meet a consumer guarantee, you’re entitled to a remedy repair, replacement or refund depending on whether the failure is minor or major.

Note: A “change of mind” is not a fault. Businesses are not legally required to accept returns for

change of mind unless they choose to offer it as store policy.


8)  Returns & Refunds (Our Policy, in addition to ACL) Faulty / not as described
  • If your item is faulty or not as described, contact us within a reasonable time with your order number, photos and a description. We’ll assess and provide a remedy consistent with the ACL (repair, replacement, or refund).
Change-of-mind returns (optional policy you can edit):
  • We accept change-of-mind returns within 30 days of delivery for full-price items only, provided items are:
    • unused, unwashed, with original tags and packaging; and
    • not underwear, socks, face coverings, or other hygiene
  • Final Sale / marked-down items aren’t eligible for change-of-mind returns (ACL remedies still apply if faulty).
  • Refunds are to the original payment method (shipping fees non-refundable unless required by the ACL).
  • You’re responsible for return shipping unless the item is
Wrong size?
  • We’re happy to exchange for another size where stock allows (same 30-day window; new

condition with tags). If out of stock, we’ll offer a refund per the above.

 

9)  Promotions, Discount Codes & Gifts
  • One code per order unless stated
  • Promotions can’t be applied to previous purchases and may exclude certain
  • If you return items purchased with a promotion, we’ll refund the amount actually paid after

discounts.

  • Gift cards are non-refundable (except as required by law); treat them like

Pre-order dates are estimates. If timelines materially change, we’ll email you options (wait, swap, or

refund).

11) User Accounts
  • Keep your login secure; you’re responsible for activity under your

12) Intellectual Property

All content (designs, product names, graphics, photos, text) is owned by or licensed to Roobaroo and protected by IP laws. You may not reproduce, sell, or exploit our content without permission. “Roobaroo” and associated logos are our trade marks.

13) Reviews & User Content

If you post reviews, photos or comments, you grant us a non-exclusive, royalty-free licence to use that content in our marketing and on our channels. Don’t post anything unlawful, defamatory, infringing or harmful.

14) Privacy

We handle personal information per our Privacy Policy (see site footer). Note: many small businesses with annual turnover under AU$3 million are exempt from the Privacy Act 1988, but some still must


comply (e.g., if they trade in personal information). Regardless, we aim to follow good privacy practices and the Australian Privacy Principles where appropriate.

15) Warranties & Liability (to the extent permitted by law)
  • We don’t exclude or limit any rights or remedies you have under the
  • Otherwise, and to the maximum extent permitted by law, we exclude all implied warranties and are not liable for indirect or consequential loss.
  • Where our liability cannot be excluded, it is limited to replacing the goods, supplying equivalent goods, repairing goods, paying the cost of replacement or repair, or refunding the amount paid (as appropriate under the ACL).
16) Unfair Contract Terms

We don’t rely on any unfair contract terms. From 9 November 2023, unfair terms in standard-form contracts are illegal and can attract significant penalties. If any provision of these Terms would be unfair under the ACL, it is not relied upon.

17) International Orders (if you ship overseas)
  • The customer is responsible for customs duties, taxes and import fees in the destination
  • Delays caused by customs are outside our
18) Force Majeure

We’re not responsible for delays or failure to perform due to events beyond our reasonable control

(e.g., natural disasters, strikes, carrier failures, government actions).

19) Changes to These Terms

We may update these Terms occasionally. The version posted on our website at the time of your order applies to that order.

20) Governing Law

These Terms are governed by the laws of Victoria, Australia (you can swap to your home State/Territory). The courts of that State have non-exclusive jurisdiction.
